Voluntary Appointment:

Effective Upon Loss of Mental Capacity:

The LPA specifically comes into effect if the donor loses mental capacity, ensuring that their chosen donee/s can step in to handle various matters, including financial, legal, and healthcare decisions.

Types of LPA:

There are two main types of power for the donee/s to decide on matters – Personal Welfare and Property & Affairs. The former addresses healthcare and personal welfare decisions, while the latter covers financial and property matters.

Decision-Making Authority:

Depending on the donor’s preferences, the donee/s can be authorised to make a wide range of decisions. There are two different LPA forms for the donor to choose from:

  1. LPA Form 1 is used if the donor wishes to give the donee/s a wide range and generic powers to make decisions.

  2. LPA Form 2 is used if the donor has more or specific requirements to be included in the LPA for the donee/s. This form requires the donor to engage a lawyer.
